Over the years, the idea of medical negligence has changed significantly
in India and around the world. This study examines how the doctrine of med-
ical negligence has been shaped by historical foundations, legislative advance-
ments, judicial interpretations, and current trends. The study intends to find
commonalities, differences, and changing standards of care by comparing the
legal systems of India. This paper also emphasizes significant rulings, legisla-
tive changes, and the expanding significance of patient rights and moral med-
ical practice. The results show that although India has made progress in identi-
fying and combating medical negligence, structural issues with awareness,
enforcement, and compensation systems still exist. The legal framework for
medical negligence in India has evolved significantly, reflecting changes in
societal values and healthcare practices. This research provides an analytical
overview of the evolution of medical negligence law in India, tracing its roots
in common law principles to its present form shaped by statutory provisions
and judicial pronouncements. |
